Terms of Use (EULA)

1. Acceptance of Terms

By downloading, installing, or using the PokerBrain iOS or Android application or visiting pokerbrain.ai, you agree to be bound by these Terms of Use and EULA ("Terms"). If you do not agree, please do not use our app or website.

We may update these Terms from time to time. Continued use after changes are posted constitutes acceptance of the revised Terms.

2. Description of Service

PokerBrain is an AI-powered poker training application for iOS and Android. The app provides:

• Simulated poker gameplay against AI opponents at varying skill levels.
• Real-time coaching, hand analysis, and GTO (Game Theory Optimal) feedback.
• Skill tracking across five dimensions (Poker IQ) to personalise your training.
• Optional in-app purchases for premium features.

The app is designed purely as a training and entertainment tool. It does not constitute real gambling in any jurisdiction.

3. No Real Money or Gambling

All chips, coins, and other in-app currency are virtual tokens with no real-world monetary value. You cannot:

• Win or lose real money through gameplay in PokerBrain.
• Exchange virtual chips for real money, prizes, or anything of tangible value.
• Use the app to facilitate real-money poker in any form.

PokerBrain is not a gambling application and is not licensed as one. It is a skill-development tool only.

4. Eligibility

You must be at least 13 years old to use PokerBrain. By using the app, you represent that you meet this age requirement. If you are under 18, you should review these Terms with a parent or guardian.

5. Subscriptions and In-App Purchases

Some features of PokerBrain are available through optional auto-renewable subscriptions and in-app purchases processed by Apple (App Store) or Google (Google Play), depending on where you installed the app. Available subscription plans, current pricing, billing period, and any free-trial offer are displayed in the app and on our pricing page before you confirm purchase.

Subscriptions renew automatically unless canceled at least 24 hours before the end of the current billing period. You can manage or cancel your subscription at any time in your Apple ID account settings (iOS) or your Google Play subscriptions (Android).

Purchases made through the App Store are also subject to Apple's App Store Terms and Conditions and, where applicable, Apple's Standard Licensed Application End User License Agreement. Purchases made through Google Play are subject to the Google Play Terms of Service. We do not process payments directly and do not store your full payment information.

Refunds for in-app purchases are handled by Apple or Google in accordance with their respective refund policies. Contact Apple Support or Google Play Support if you need assistance with a refund.

6. Intellectual Property

All content, design, code, branding, and materials within PokerBrain and on this website are the exclusive property of PokerBrain and its licensors. You may not copy, reproduce, distribute, or create derivative works without our express written permission.

You are granted a limited, non-exclusive, non-transferable licence to use the app on your personal iOS or Android device for your own training and entertainment purposes.

7. Prohibited Conduct

You agree not to:

• Reverse engineer, decompile, or tamper with the app.
• Use cheats, bots, or automation tools to manipulate gameplay.
• Circumvent or attempt to circumvent any in-app purchase requirements.
• Use PokerBrain for any unlawful purpose or in violation of any applicable law.
• Misrepresent your identity when contacting us.

8. Disclaimers

PokerBrain is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the app will be error-free, uninterrupted, or that any coaching advice will guarantee improved performance in real poker games.

Poker coaching content within the app is based on mathematical game theory and is intended for educational purposes. Results in real poker games may vary significantly based on factors outside our control.

9. Limitation of Liability

To the fullest extent permitted by law, PokerBrain shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of — or inability to use — the app or website. Our total liability to you for any claims arising from these Terms shall not exceed the amount you paid us in the twelve months preceding the claim (or $10 USD, whichever is greater).

10. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration or in the courts of the jurisdiction in which PokerBrain is headquartered.
